How no win, no fee works

If a solicitor takes your case on, they’ll normally offer a conditional fee agreement, often called no win, no fee. In short:

  • 01If you lose, you don’t pay the solicitor’s fee. Many firms also arrange insurance so you’re not left paying the other side’s costs.
  • 02If you win, your landlord usually pays a large part of your legal costs, and the solicitor may take a success fee from your compensation.

The solicitor must explain their fees clearly, in writing, before you agree to anything. Ask them what percentage of your compensation you could pay, so you know what you’d keep.

Smaller claims

If the repairs and the compensation are both worth less than about £1,000, the claim may fall into the small claims track, where legal costs usually can’t be recovered from the landlord. In that case a solicitor may not take it on, but you can still use your landlord’s complaints process and the Housing Ombudsman for free.

Who handles your claim

With your agreement, we pass your claim to RFLCS Ltd (trading as Home Disrepair Claims), a claims management company authorised and regulated by the Financial Conduct Authority (FRN 978092). It introduces your claim to one solicitor at a time from its panel. The solicitor explains their terms, fees and your right to cancel before you sign anything. Our partners
